Some online transparency is required by the 2019 Data Protection Act (DPA)
section 24 (6)
6. A data controller or data processor shall publish the contact details of
the data protection officer on the website and communicate them to the Data
Commissioner who shall ensure that the same information is available on the
official website.
*How will the ICTA deal with state departments & corporations failing to
provide access to public information? The Data Commissioner? EACC? CAJ?*
Is this captured (addressed) in the 2019-2023 strategy?

local data processing (to promote data centre setups in Kenya) *
50. The Cabinet Secretary may prescribe, based on grounds of strategic
interests of the state or protection of revenue, certain nature of
processing that shall only be effected through a server or a data centre

Section 4: The functions of the authority shall be to –
(a) set and enforce ICT standards & guidelines for human resource,
infrastructure, processes, systems and technology for the public office and
public service
(c) facilitate and regulate the design, implementation and use of ICTs in
the public service;
(d) promote ICT literacy and capacity
*(g) promote ICT innovation and enterprise*
(f) facilitate optimal electronic, electronic form, electronic record and
equipment use in the public service;
